Lot 189 Tofo / Tofinho, and Sulemane Cabir - Inhambane, Mozambique

We have finally received our published Articles of Association for our company Marlyn Azul LDA which was published in the Boletim da República (Official Gazette) in February 2008.

We paid Sulemane Cabir on 09 April 2007 for this and only after following up with Dr Manuel Malunga ourselves have we had any joy.

Sulemane Cabir has given us a signed declaration that he paid the money and handed over the documents in April 2008. We are trying to establish from Dr Malunga whether this was in fact given to him in April 2007 and to get our receipt for this.

Lot 189 Tofo / Tofinho, Inhambane, Mozambique

Thank you for all your information and advice regarding the processes to acquire property in Inhambane, Mozambique and our dealings with Sulemane Cabir.

We found nothing on the web regarding Lot 189 Tofo / Tofinho, Inhambane, Mozambique and Sulemane Cabir until 17 February 2007. It is good to know that any potential person planning on dealing with Sulemane Cabir who searches the web will come across this blog and know the process regarding acquiring property in Inhambane, Mozambique and go into any dealings with Sulemane Cabir with their eyes open.

Sulemane Cabir was not upfront and informed us that all was in order, when he knew he had issues with the Inhambane Municipal. Further more it has now come to light that the moneys we paid Sulemane Cabir for the processes did not appear to have been used to apply for our various licenses. Sulemane Cabir ended up costing us a lot in time!!!

Anonymous Post - Lot 189 Tofo / Tofinho, Inhambane, Mozambique

I am not sure whether you saw an earlier comment posted by an Anonymous visitor on 11 Januray 2008 who appears to be living in Inhambane. I have pasted this below for your info.

"I recommend you guys get the advice of a reputable laywer or legal advisor. Having been here in Inhambane many years, I have seen many people been ripped off due to there lack of knowledge of the laws of Mozambique. Remember too that if your a foreigner or non-resident you are not allowed to own land in Mozambique. Many people or opening front companies to bypass this law, but I assure you the goverment is closing all those loopholes, so be sure you are not caught with your pants down. Be especially careful with all those so called lodges in Tofo and Barra that are selling holiday houses, it might seem the goverment is ignoring them now but be assured that someting will happen shortly."

In your dealings with Sulemane Cabir we would also suggest you take on the services of a lawyer who is able to solve the problems you have had landed up with in dealing with Sulemane Cabir. It would be interesting to know if this Anonymous visitor knows / has dealt with Sulemane Cabir or whether he knows of any persons who have had dealings with Sulemane Cabir.

It sounds like you trusted in Sulemane Cabir without actually personally checking on the process and obtaining the receipts and documentation from Sulemane Cabir. Unfortunately this has happened to many people in Mozambique as dealing in Portuguese is often a stumbling block and trusting a local Mozambique person appears to be the only way.

I would strongly suggest to any person doing business in Mozambique to deal with a reputable Lawyer - from Mozambique or South Africa - as did a previous visitor to this blog.
